Voicely Translate Terms of Service

These Terms govern Voicely Translate, operated by Gozar Productions LLC ("we," "us," or "our"). By installing, starting, participating in, purchasing credits for, or using the Bot, you agree to these Terms. If you act for a server or organization, you represent that you may bind it.

The Service

During an active session, Voicely Translate:

1. receives voice audio from the selected Discord channel;
2. sends buffered speech audio to OpenAI for transcription;
3. sends transcripts to OpenAI for language identification and translation; and
4. posts the resulting text in Discord.

Automated output may mishear, omit, invent, or mistranslate content. Do not rely on it for emergencies, legal or medical decisions, safety-critical communication, or other high-risk uses.

Voice Notice, Consent, and Eligibility

You must meet Discord's minimum age for your country. Server administrators and users who start sessions are responsible for:

• ensuring the Bot is authorized in the server and channel;
• giving participants clear notice; and
• obtaining any consent required by recording, interception, wiretap, biometric, employment, or privacy law.

A Bot join notice may not satisfy every local requirement. Do not use the Service for covert surveillance.

Acceptable Use

You must comply with Discord's and applicable providers' terms and all applicable law. You may not use the Bot to:

• harass, threaten, or unlawfully monitor anyone;
• infringe rights or process content without authority;
• evade payment, access, rate, or security controls;
• exploit vulnerabilities or create unreasonable cost or load;
• present generated output as guaranteed accurate; or
• interfere with the Service or others.

Credits, Purchases, and Refunds

Some use requires prepaid Voicely Credits:

• Value: unless stated otherwise at purchase, 100 Credits represents USD $1.00 of purchased balance.

• Assignment: Credits are assigned to a Discord server, not an individual user.

• Consumption: Credits are consumed according to measured transcription and translation usage.

• No cash value: Credits are not transferable or redeemable for cash.

• Pricing: usage pricing may include a multiplier above provider cost.

• Payment provider: purchases may be processed by Ko-fi or another disclosed provider.

• Activation: you are responsible for entering the correct server activation code; missing or incorrect codes can delay crediting.

• Refunds: except where law requires otherwise, consumed credits are non-refundable.

• Payment problems: contact us about duplicate charges or failed activation.

• Reversals and abuse: fraud, chargebacks, reversals, or abuse may result in credits being removed or access restricted.

Trial, promotional, complimentary, or unlimited access may be changed or discontinued and has no cash value. Changes to future rates will not retroactively remove already credited purchased balance, but the amount of Service usage that balance buys may change prospectively with notice where required.

Privacy, Content, and Providers

Our processing is described in the Voicely Translate Privacy Policy. Discord, OpenAI, Ko-fi, and Cloudflare have their own terms and policies. You retain rights in content you provide and grant us a limited permission to receive, buffer, transmit, transcribe, translate, display, and temporarily store it only to operate, secure, bill, and support the Service. You represent that you have the necessary rights and permissions.

We and our licensors retain rights in the Bot and branding. These Terms give you a limited, revocable, non-transferable right to use the Service. Feedback may be used without restriction or compensation.

Availability and Suspension

The Service is provided on an "as is" and "as available" basis and depends on third parties. We may change, rate-limit, suspend, or discontinue features. We may restrict access for security, legal compliance, abuse prevention, nonpayment, excessive cost, provider restrictions, or violation of these Terms. Removing the Bot does not automatically create a refund or erase billing records.

Disclaimers and Liability

To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted, secure, error-free, or accurate transcription, translation, attribution, or usage calculation.

To the maximum extent permitted by law, Gozar Productions LLC and its members, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, reputational harm, or business interruption. Our total liability for claims relating to the Service will not exceed the greater of USD $100 or the amount you paid for Voicely Translate during the six months before the event giving rise to the claim. These limits do not exclude liability or consumer rights that cannot lawfully be limited.

Governing Law and Changes

Arizona law governs these Terms, excluding conflict-of-law rules, except where mandatory local law applies. Before filing a claim, contact us and allow 30 days for informal resolution. Courts with jurisdiction in Arizona will be the exclusive venue where legally permitted.

If a provision is unenforceable, the remainder remains effective. Failure to enforce is not a waiver. We may update these Terms by posting a revised version and date. Material changes apply prospectively with notice where required; continued use after they take effect means acceptance to the extent permitted by law.
